PLEASE READ CAREFULLY. This document ("Terms") is a binding agreement between you (the "User") and Photo - Picture keyboard (the "Publisher," "we," "us," or "our") concerning your use of the mobile application Messages: SMS, Text & Chat (the "App"). By downloading, installing, accessing, or otherwise using the App, you confirm that you accept and agree to comply with these Terms. If you do not agree, please refrain from using the App.

SECTION 1 — OVERVIEW OF THE APP

The App is a mobile messaging tool designed to help users send, receive, view, and manage SMS and MMS text communications from a single, streamlined interface. Additional features may include conversation folders, keyboard and theme customization, notification management, and message search.

SECTION 2 — ELIGIBILITY

You confirm, by using the App, that:

2.1 You meet the minimum legal age to use mobile messaging services in your country of residence; 2.2 If you are a minor under local law, you have obtained consent from a parent or legal guardian; 2.3 You possess the legal authority to enter into this Agreement and will use the App only for lawful purposes.

SECTION 3 — DEVICE PERMISSIONS

To operate, the App may request the following permissions from your device:

3.1 Default SMS/MMS handling — to send, receive, and display text messages; 3.2 Contacts — to associate phone numbers with contact names; 3.3 Camera and photo gallery — to capture, attach, and view shared images or media; 3.4 Storage — to save attachments and, where enabled, local backups; 3.5 Notifications — to alert you to new messages and app activity.

You may disable any of these permissions in your device's settings at any time. Doing so may limit certain features of the App.

SECTION 4 — ACCEPTABLE USE

You agree that you will NOT use the App to:

4.1 send unsolicited bulk messages, spam, or fraudulent communications; 4.2 harass, threaten, defame, stalk, or impersonate any individual or organization; 4.3 distribute content that is unlawful, obscene, hateful, or infringes on the rights of others; 4.4 attempt to hack, disrupt, reverse-engineer, or gain unauthorized access to the App or its systems; 4.5 violate any applicable telecommunications, privacy, or consumer protection law.

Failure to comply with this Section may result in suspension or termination of your access to the App.

SECTION 5 — MESSAGE CONTENT AND OWNERSHIP

5.1 You retain full ownership of all messages, photos, and other content sent or received via the App. 5.2 Photo - Picture keyboard does not claim ownership over, and does not routinely monitor, the substance of your private communications. 5.3 Where optional cloud backup or sync features are made available, their use and associated data handling are governed by our separate Privacy Policy and require your affirmative consent.

SECTION 6 — CARRIER NETWORK AND FEES

6.1 The App relies on your device's SIM card and cellular or data network to function. 6.2 Photo - Picture keyboard is not responsible for SMS, MMS, or data charges billed by your mobile carrier, nor for delivery delays or failures caused by network conditions outside our control. 6.3 Users are encouraged to confirm their messaging and data plan details directly with their carrier.

SECTION 7 — INTELLECTUAL PROPERTY

7.1 All intellectual property rights in the App — including its source code, design, trademarks, and branding — belong to Photo - Picture keyboard or its licensors. 7.2 You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for personal purposes only. 7.3 You may not copy, modify, reverse-engineer, distribute, sell, rent, or sublicense the App, nor use our name or branding without prior written consent.

SECTION 8 — THIRD-PARTY SERVICES

The App may integrate with or link to third-party services, including cloud storage providers, sticker or emoji packs, and analytics tools. These services are governed by their own separate terms and privacy practices. Photo - Picture keyboard does not control and is not liable for the practices of such third parties.

SECTION 9 — PRIVACY

Our collection, use, and protection of your personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described therein.

SECTION 10 — MODIFICATIONS TO THE APP

Photo - Picture keyboard reserves the right, at its sole discretion and without prior notice, to:

10.1 release updates, patches, or new versions of the App; 10.2 add, modify, or remove features of the App; 10.3 temporarily suspend the App for maintenance or technical reasons.

SECTION 11 — SUSPENSION AND TERMINATION

We may suspend or terminate your access to the App at any time, without prior notice, if we determine, in good faith, that you have violated these Terms or engaged in conduct harmful to other users, third parties, or Photo - Picture keyboard.

SECTION 12 — DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

SECTION 13 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Photo - Picture keyboard shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of messages, data, or profits — arising from or related to your use of the App. This limitation does not apply to liability that cannot be lawfully excluded, including liability for death, personal injury, or fraud.

SECTION 14 — AMENDMENTS TO THESE TERMS

We may revise these Terms periodically to reflect changes in our practices, features, or applicable law. Material updates will be communicated through the App or its official store listing. Continued use of the App after such changes take effect constitutes your acceptance of the revised Terms.

SECTION 15 — GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws applicable to the Publisher's principal place of business, without regard to conflict-of-law principles.
