Thank you for choosing Messages: SMS Texting App (referred to below as "the App"). This Terms of Use agreement is a legal contract between you and Photo-Picture Keyboard ("we," "us," "our"). By installing, opening, or otherwise using the App, you agree to be bound by everything written here. If any part of it doesn't sit right with you, please don't use the App.

1. Who This Agreement Covers

This agreement applies to anyone who downloads, installs, or otherwise interacts with the App on any device. By using the App, you confirm you're old enough to legally use messaging services where you live, and that you'll follow the rules laid out here.

2. What the App Lets You Do

Messages: SMS Texting App is built to let you:

  • Send and receive standard SMS and MMS texts;
  • View, sort, and search your conversation history;
  • Attach photos, videos, and files to your messages;
  • Customize notifications, chat backgrounds, and display preferences;
  • Optionally back up conversations if that feature is enabled and permitted.

3. Permissions the App May Ask For

To work properly, the App may ask for access to:

4. Rules for Using the App

You agree not to use the App to:

  • Send spam, mass unsolicited texts, or scam messages;
  • Threaten, harass, stalk, or impersonate someone;
  • Share illegal, obscene, or rights-infringing content;
  • Try to hack, exploit, or disrupt the App or its backend systems;
  • Break any telecom, privacy, or communications law that applies to you.

Breaking these rules may result in your access to the App being limited or revoked.

5. Your Messages Belong to You

We don't claim ownership of anything you write, send, or receive. Photo-Picture Keyboard Works does not read, sell, or monitor the content of your private conversations. If you choose to enable optional cloud backup, that data is handled per our separate Privacy Policy, and only with your permission.

6. Carrier Fees and Network Reliability

The App works through your phone's SIM and cellular/data connection. We don't control your carrier's network, so we can't be held responsible for:

  • Standard SMS, MMS, or data charges from your provider;
  • Delayed, dropped, or failed message delivery due to network issues;
  • Any extra costs from international texting or roaming.

Check with your carrier if you're unsure about your messaging plan.

7. Ownership of the App Itself

Photo-Picture Keyboard Works owns the App's design, code, name, and branding. You're given a personal, non-transferable license to use it — nothing more. You may not:

  • Copy, modify, or reverse-engineer any part of the App;
  • Resell, rent, or redistribute the App;
  • Use our name or logo without asking us first in writing.

8. Third-Party Tools

The App may connect to outside services (like backup storage, sticker packs, or ad networks). Those services have their own rules and privacy practices that we don't control. Use them at your own discretion.

9. Privacy

How we collect and use your data is explained in our Privacy Policy, which works alongside these Terms. Using the App means you're okay with what's described there.

10. Updates, Changes, and Downtime

We may update, tweak, or temporarily pause parts of the App to fix bugs, add features, or perform maintenance. We'll try to keep disruptions minimal, but we can't promise the App will always be available without interruption.

11. Ending Your Access

If you seriously or repeatedly break these Terms, we may suspend or shut off your access to the App without advance warning.

12. No Guarantees

The App is provided "as-is." We don't promise it will be perfect, bug-free, or available every second of every day. To the extent the law allows, we don't offer any warranties beyond what's legally required.

13. Limits on Our Responsibility

We're not liable for indirect or consequential damages — like lost messages, lost data, or lost business — that come from using or being unable to use the App. This doesn't affect any liability that can't legally be limited, such as for death, injury, or fraud.

14. Changes to These Terms

We may update this agreement from time to time. If we make significant changes, we'll let you know through the App or its store listing. Using the App after an update means you accept the new terms.

15. Governing Law

This agreement is governed by the laws that apply to Photo-Picture Keyboard Works' place of business, regardless of conflict-of-law rules.
